Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Sunmoon, including our mobile applications, services, features, software, and website (collectively, the “Services”).

Sunmoon is operated by Moonrain Labs Private Limited (“Sunmoon,” “we,” “our,” or “us”).

By downloading, installing, accessing, or using our Services, you agree to these Terms and our Privacy Policy.

If you do not agree with these Terms, you must not use Sunmoon.

1. About Our Services

Sunmoon is designed to help people connect more intentionally through presence, shared moments, and lightweight social interaction.

Our Services may include:

  • Sharing photos, videos, voice notes, and updates
  • Showing availability status (“sun” / “moon”)
  • Messaging and social interactions
  • Friend discovery and contact syncing
  • Safety, moderation, and reporting tools
  • Future features and integrations

We are constantly improving our Services and may add, modify, suspend, or remove features at any time.

2. Eligibility and Registration

Minimum Age

You must be at least 18 years old to create or use a Sunmoon account.

By using Sunmoon, you represent and warrant that:

  • You are at least 18 years old
  • You are legally capable of entering into these Terms
  • You are not prohibited from using our Services under applicable law

Registration

To use Sunmoon, you must provide:

  • A valid mobile phone number
  • Accurate and current account information

You agree to keep your information updated.

You are responsible for all activity conducted through your account.

Devices and Connectivity

You are responsible for obtaining and maintaining:

  • Compatible devices
  • Internet access
  • Carrier services
  • Data plans and related fees

We are not responsible for carrier charges or connectivity issues.

3. Privacy and User Data

Your privacy matters to us.

Our Privacy Policy explains how we collect, use, process, store, and share your information.

By using Sunmoon, you acknowledge that your information will be handled as described in our Privacy Policy.

4. Acceptable Use of Our Services

You must use Sunmoon lawfully, responsibly, and respectfully.

You may not use Sunmoon to:

  • Violate any law or regulation
  • Harass, threaten, intimidate, stalk, or abuse others
  • Share unlawful, hateful, sexually exploitative, or violent content
  • Exploit or endanger minors
  • Impersonate another person or organization
  • Spread spam, scams, malware, or deceptive content
  • Coordinate harm or illegal activity
  • Interfere with or disrupt our Services
  • Circumvent security or access controls
  • Scrape, crawl, reverse engineer, or copy our Services
  • Create fake accounts or use automated systems without authorization
  • Use Sunmoon for unauthorized commercial mass messaging

We may investigate violations and take action including:

  • Removing content
  • Restricting features
  • Suspending accounts
  • Permanently banning users
  • Reporting unlawful activity to authorities

5. Your Content

Ownership

You retain ownership of the content you create and share through Sunmoon.

Nothing in these Terms transfers ownership of your content to us.

License You Grant to Sunmoon

To operate and provide our Services, you grant Sunmoon a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, process, reproduce, modify, adapt, display, and distribute content you upload or share through the Services.

This license is limited to the purpose of:

  • Operating the Services
  • Delivering content to intended recipients
  • Improving functionality and safety
  • Moderating abuse and enforcing policies
  • Developing and improving features

This license ends when your content is deleted from our systems, except where retention is required for legal, security, or operational reasons.

Responsibility for Content

You are solely responsible for the content you create, upload, send, or share.

You represent and warrant that:

  • You own or have the necessary rights to your content
  • Your content does not violate law or third-party rights
  • Your content complies with these Terms

6. Ephemeral Content

Some Sunmoon content is designed to disappear automatically after a limited period.

However, you understand and agree that:

  • Recipients may capture screenshots or recordings
  • Content may persist temporarily in backups or systems
  • We cannot guarantee permanent deletion in all circumstances

7. Contact Upload and Friend Discovery

You may choose to upload your contacts to help discover friends on Sunmoon.

You represent that you have the necessary rights and permissions to share contact information with us for this purpose.

You can revoke contact permissions through your device settings at any time.

8. Safety and Moderation

We work to maintain a safe environment on Sunmoon.

We may use automated systems and human review to:

  • Detect abuse and spam
  • Investigate reports
  • Enforce policies
  • Protect users and platform integrity

We reserve the right to remove content or restrict accounts that violate our Terms or create risk for users, Sunmoon, or third parties.

9. Third-Party Services

Sunmoon may integrate with or rely on third-party services, including:

  • Apple App Store
  • Google Play
  • Cloud hosting providers
  • Analytics providers
  • Notification services

Your use of third-party services may also be governed by their own terms and privacy policies.

We are not responsible for third-party services or content.

10. Intellectual Property

All rights, title, and interest in Sunmoon and our Services — including software, branding, logos, designs, trademarks, graphics, and technology — belong to Moonrain Labs Private Limited or our licensors.

Except as expressly permitted, you may not:

  • Copy
  • Modify
  • Reverse engineer
  • Distribute
  • Sell
  • License
  • Exploit

any part of our Services without our written permission.

11. Feedback

If you provide suggestions, ideas, or feedback regarding Sunmoon, you grant us the right to use that feedback without restriction or compensation to you.

12. Termination

You may stop using Sunmoon and delete your account at any time.

We may suspend, disable, restrict, or terminate your access to the Services if:

  • You violate these Terms
  • We believe your actions create legal or security risk
  • We are required to comply with law
  • Your account remains inactive for an extended period

We may remove or retain certain information as required by law, safety, or legitimate business purposes.

13. Availability of Services

We strive to keep Sunmoon available and reliable, but we do not guarantee uninterrupted availability.

Our Services may be affected by:

  • Maintenance
  • Updates
  • Device compatibility
  • Network failures
  • Security incidents
  • Events beyond our control

We may change, suspend, or discontinue parts of the Services at any time.

14. Disclaimers

SUNMOON IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • AVAILABILITY
  • SECURITY
  • ACCURACY

WE DO NOT GUARANTEE THAT:

  • THE SERVICES WILL ALWAYS BE SAFE, SECURE, OR ERROR-FREE
  • CONTENT WILL ALWAYS BE AVAILABLE OR PRESERVED
  • THE SERVICES WILL OPERATE WITHOUT INTERRUPTIONS OR DELAYS

YOU USE SUNMOON AT YOUR OWN RISK.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUNMOON, MOONRAIN LABS PRIVATE LIMITED, AND OUR DIRECTORS, EMPLOYEES, PARTNERS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES
  • INCIDENTAL DAMAGES
  • SPECIAL DAMAGES
  • CONSEQUENTIAL DAMAGES
  • LOSS OF DATA
  • LOSS OF PROFITS
  • LOSS OF GOODWILL

ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

  • INR 10,000
  • THE AMOUNT YOU PAID US IN THE PREVIOUS 12 MONTHS

Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless Sunmoon, Moonrain Labs Private Limited, and our affiliates, officers, employees, and partners from claims, liabilities, damages, losses, and expenses arising from:

  • Your use of the Services
  • Your content
  • Your violation of these Terms
  • Your violation of law or third-party rights

17. Governing Law and Disputes

These Terms are governed by the laws of India.

Any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

Before initiating formal legal proceedings, you agree to first contact us and attempt to resolve the dispute informally.

18. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will provide notice through the app, website, or other appropriate means.

Your continued use of Sunmoon after the updated Terms become effective means you accept the revised Terms.
